These Terms & Conditions ("Terms") govern the relationship between phky ("the Platform," "we," "us," or "our") and any individual ("Player," "User," "you," or "your") who accesses, registers on, or uses the phky online gaming platform available at phky.app and any associated mobile applications or services.

By completing the registration process, clicking "I Agree," or by simply accessing and using any part of the phky platform, you acknowledge that you have read these Terms in full, that you understand them, and that you unconditionally agree to be bound by them. These Terms apply to all users of the phky platform, including registered players, guests, and any other persons who access the platform in any capacity.

These Terms should be read in conjunction with phky's Privacy Policy and Responsible Gaming Policy, both of which are incorporated herein by reference and form part of the overall agreement between you and phky.

If you are accessing phky on behalf of another person or entity, you represent and warrant that you have the authority to bind that person or entity to these Terms, and that by using the platform, that person or entity also accepts these Terms.

Access to and use of the phky platform is subject to the following eligibility requirements, all of which must be satisfied at the time of registration and on a continuing basis throughout your use of the platform:

• Age: You must be at least 21 years of age at the time of registration. This requirement is in accordance with PAGCOR regulations governing online gaming in the Philippines. phky strictly prohibits access by minors and will take all reasonable steps to enforce this restriction, including mandatory identity verification.
• Jurisdiction: You must be physically located within a jurisdiction where online gaming is lawful. phky's services are primarily directed at players in the Philippines. It is your sole responsibility to determine whether online gaming is legal in your location before registering.
• Legal Capacity: You must have full legal capacity to enter into a binding contract under the laws of the Philippines. Persons who have been declared legally incapacitated by a court of competent jurisdiction are not eligible to register.
• Not Self-Excluded: You must not be subject to any self-exclusion order, whether imposed by phky or by any regulatory authority, at the time of registration or during your use of the platform.
• Not a Prohibited Person: You must not be an employee, contractor, director, officer, or agent of phky, or an immediate family member of any such person, unless phky has provided explicit written consent for such participation.

phky reserves the right to request documentary proof of eligibility at any time. Failure to provide satisfactory documentation within a reasonable timeframe may result in account suspension or closure, and any pending withdrawals may be withheld pending verification.

To access the full range of phky's gaming services, you must create a registered account. The following terms apply to the registration and maintenance of your phky account:

• One Account Per Person: Each individual is permitted to hold only one phky account. The creation of multiple accounts by the same individual — whether using different names, email addresses, payment methods, or devices — is strictly prohibited. phky employs technical and manual measures to detect duplicate accounts, and any accounts identified as duplicates may be closed without notice, with all associated balances and bonuses forfeited.
• Accurate Information: You must provide accurate, complete, and truthful information during registration and must keep your account details up to date at all times. phky is not responsible for any losses arising from inaccurate account information provided by you.
• Account Security: You are solely responsible for maintaining the confidentiality of your login credentials, including your username and password. You must not share your account credentials with any third party. phky will not be liable for any losses resulting from unauthorized access to your account caused by your failure to maintain adequate security.
• KYC Verification: phky is required by its regulatory obligations to verify the identity of all players. You will be required to submit a valid government-issued photo ID (such as a Philippine passport, driver's license, or SSS/UMID card) and proof of your registered payment method before withdrawals can be processed. phky may request additional documentation at any time.
• Account Closure: phky reserves the right to suspend or permanently close any account that is found to be in breach of these Terms, without prior notice and without liability to the account holder.

phky supports a range of payment methods commonly used by Filipino players, including GCash, PayMaya, BPI, BDO, and Metrobank. The following terms govern all financial transactions on the phky platform:

• Minimum Deposit: The minimum deposit amount is ₱100. Deposits below this threshold will not be credited to your account.
• Deposit Processing: GCash and PayMaya deposits are typically credited instantly. Bank transfers may take up to one business day depending on your financial institution. phky is not responsible for delays caused by third-party payment processors or banks.
• Withdrawal Eligibility: Withdrawals are only available to players who have completed KYC verification. Withdrawal requests will not be processed until identity verification is complete and satisfactory.
• Withdrawal Processing Times: GCash and PayMaya withdrawals are typically processed within 5 to 30 minutes of approval. Bank transfers may take one to three business days. Processing times may be extended during periods of high demand or for accounts undergoing additional review.
• Currency: All transactions on the phky platform are conducted in Philippine Peso (₱ / PHP). phky is not responsible for any currency conversion fees charged by your bank or payment provider.
• Source of Funds: You warrant that all funds deposited into your phky account are from legitimate sources and are not the proceeds of any illegal activity. phky reserves the right to request proof of source of funds at any time and to withhold withdrawals pending such verification.
• Inactive Accounts: Accounts that have had no login activity for a period of 12 consecutive months may be classified as inactive. phky reserves the right to apply an administrative fee to inactive accounts in accordance with its prevailing fee schedule, which will be communicated to you in advance.

phky offers various bonuses and promotional offers to both new and existing players. All bonuses are subject to the following general terms, in addition to any specific terms attached to each individual promotion:

• Wagering Requirements: All bonus funds are subject to wagering requirements before they can be withdrawn. The applicable wagering multiplier will be clearly stated in the terms of each promotion. Bonus funds and any winnings derived from them cannot be withdrawn until the wagering requirement has been fully satisfied.
• Eligibility: Bonuses are available to eligible registered players only. phky reserves the right to determine eligibility for any promotion at its sole discretion. Players who have self-excluded or who are subject to account restrictions are not eligible for bonuses.
• One Bonus at a Time: Unless otherwise stated, only one bonus may be active on your account at any given time. Attempting to claim multiple bonuses simultaneously may result in the cancellation of all active bonuses.
• Abuse and Fraud: phky reserves the right to void any bonus and confiscate associated winnings if it determines, in its sole discretion, that a player has engaged in bonus abuse, collusion, arbitrage betting, or any other form of fraudulent activity in connection with a promotion.
• Expiry: Bonus funds that are not used within the validity period specified in the promotion terms will expire and be removed from your account without notice.
• Modification and Cancellation: phky reserves the right to modify, suspend, or cancel any promotion at any time without prior notice. Changes will not affect bonuses already credited to player accounts, except where fraud or abuse is suspected.

All games available on the phky platform are governed by individual game rules, which are accessible within each game interface. The following general principles apply to all gaming activity on phky:

• Random Number Generation: All phky casino games use certified Random Number Generator (RNG) technology to ensure fair and unpredictable outcomes. Live dealer games are conducted by trained dealers in real time and are subject to the same fairness standards.
• Game Malfunctions: In the event of a technical malfunction, game error, or system failure that affects the outcome of a game, phky reserves the right to void the affected round and refund the wager to the player's account. phky's decision in such matters is final.
• Bet Limits: Each game on the phky platform has minimum and maximum bet limits, which are displayed within the game interface. phky reserves the right to modify bet limits at any time.
• Disconnection Policy: If you are disconnected from the platform during an active game round, phky's system will attempt to complete the round according to the game's standard rules. phky is not liable for losses resulting from disconnections caused by your internet service provider or device.
• Disputed Results: If you believe a game result is incorrect, you must contact phky's support team within 72 hours of the disputed event. phky will investigate the matter and its decision, based on server-side records, shall be final and binding.

The following conduct is strictly prohibited on the phky platform. Engaging in any of the following may result in immediate account suspension, permanent closure, forfeiture of balances, and referral to relevant law enforcement or regulatory authorities:

• Registering or attempting to register more than one account on the phky platform.
• Providing false, misleading, or fraudulent information during registration or at any point during your use of the platform.
• Using the platform if you are under 21 years of age, or allowing a minor to access your account.
• Engaging in any form of collusion, chip dumping, match-fixing, or coordinated play designed to gain an unfair advantage.
• Using automated software, bots, scripts, or any other artificial means to interact with the platform or its games.
• Exploiting software bugs, glitches, or errors in a manner that provides an unfair advantage. Any winnings obtained through exploitation of errors must be returned to phky.
• Engaging in money laundering, fraud, or any other illegal financial activity through the phky platform.
• Attempting to reverse-engineer, decompile, or otherwise tamper with the phky platform's software or security systems.
• Harassing, threatening, or abusing phky staff, support agents, or other players through any communication channel.
• Accessing the platform from a jurisdiction where online gaming is prohibited by law.

phky is committed to promoting responsible gaming and takes its obligations in this area seriously. Gaming on the phky platform is intended to be a form of entertainment. It should never be used as a means to generate income or to recover financial losses.

phky provides the following responsible gaming tools to all registered players:

• Deposit Limits: Players may set daily, weekly, or monthly deposit limits on their accounts. Once set, limits can be decreased immediately but increases are subject to a cooling-off period.
• Loss Limits: Players may set limits on the amount they are willing to lose within a defined period.
• Session Time Reminders: Players may configure reminders that notify them of the duration of their gaming sessions.
• Cooling-Off Periods: Players may request a temporary suspension of their account for a defined period ranging from 24 hours to 6 months.
• Self-Exclusion: Players who feel they need a longer break from gaming may request permanent or long-term self-exclusion. Self-excluded players will not be permitted to re-register during the exclusion period.

phky reserves the right to impose any of the above restrictions on any account where problem gambling behavior is identified, without requiring the player's consent. The welfare of our players takes precedence over commercial considerations.

All content on the phky platform, including but not limited to text, graphics, logos, icons, images, audio clips, game software, and the overall design and layout of the platform, is the property of phky or its licensors and is protected by applicable intellectual property laws, including the Intellectual Property Code of the Philippines (Republic Act No. 8293).

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the phky platform solely for your personal, non-commercial entertainment purposes. This license does not include the right to:

• Copy, reproduce, distribute, or publicly display any content from the phky platform without prior written consent.
• Modify, adapt, translate, or create derivative works based on any phky content.
• Use any phky trademarks, logos, or brand elements in any manner that could cause confusion or imply endorsement.
• Scrape, crawl, or systematically extract data from the phky platform using automated tools.

Any unauthorized use of phky's intellectual property may result in legal action. phky reserves all rights not expressly granted in these Terms.

To the fullest extent permitted by applicable law, phky, its directors, officers, employees, agents, licensors, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the phky platform, including but not limited to:

• Loss of profits, revenue, data, or goodwill.
• Losses arising from technical malfunctions, server downtime, or interruptions to the platform.
• Losses resulting from unauthorized access to your account due to your failure to maintain account security.
• Losses arising from your reliance on any information or content provided on the platform.
• Losses resulting from delays in deposit or withdrawal processing caused by third-party payment providers.

phky's total aggregate liability to you for any claim arising out of or in connection with these Terms or your use of the platform shall not exceed the total amount deposited by you into your phky account in the 30-day period immediately preceding the event giving rise to the claim.

Nothing in these Terms shall limit or exclude phky's liability for fraud, gross negligence, or any other liability that cannot be excluded or limited under applicable Philippine law.

phky collects, processes, and stores personal data in accordance with the Data Privacy Act of 2012 (Republic Act No. 10173) and its implementing rules and regulations. The collection and use of your personal data is governed by phky's Privacy Policy, which is incorporated into these Terms by reference.

By registering on the phky platform, you consent to the collection and processing of your personal data as described in the Privacy Policy, including for the purposes of account management, KYC verification, fraud prevention, regulatory compliance, and the provision of phky's gaming services.

phky will not sell your personal data to third parties. Data may be shared with regulatory authorities, payment processors, and identity verification service providers as required for the operation of the platform and compliance with applicable law.

phky reserves the right to amend, update, or replace these Terms & Conditions at any time. When material changes are made, phky will notify registered players via email or through a prominent notice on the platform at least 7 days before the changes take effect, except where immediate changes are required by law or regulatory directive.

Your continued use of the phky platform after the effective date of any amended Terms constitutes your acceptance of the revised Terms. If you do not agree to the amended Terms, you must cease using the platform and may request account closure by contacting phky's support team.

The most current version of these Terms will always be available on this page, along with the date of the most recent update. We encourage you to review these Terms periodically to stay informed of any changes.

These Terms & Conditions shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions.

In the event of any dispute, controversy, or claim arising out of or relating to these Terms or your use of the phky platform, the parties agree to first attempt to resolve the matter through good-faith negotiation. You may initiate this process by contacting phky's support team with a written description of your complaint.

If a dispute cannot be resolved through negotiation within 30 days, either party may submit the matter to the exclusive jurisdiction of the appropriate courts of the Philippines. You irrevocably consent to the personal jurisdiction of such courts for this purpose.

Notwithstanding the foregoing, phky reserves the right to seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights or to prevent irreparable harm.
